Terms of Service
A Terp is yours to keep, to carry, and to care for. These terms are the small print for living with a creature that sees.
1. Agreement to these terms
These Terms of Service ("Terms") are a legal agreement between you and Terp ("we," "us," "our") governing your use of the Terp device, companion app, and owner portal ("the Service"). By creating an account, binding a device, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. You must be 18 or older
You must be at least 18 years old to create an account and operate a Terp. By using the Service you confirm that you are an adult and that the information you give us is accurate. The Service is not directed to children, and accounts may not be created by or for anyone under 18.
3. Your account
You are responsible for keeping your login credentials safe and for everything that happens under your account. Tell us promptly at support@terp.com if you believe your account has been compromised.
4. Using a device that records people
A Terp has a camera and microphone and can capture identifiable people. With that comes responsibility. You agree that:
- You will place and use your Terp only where you have the right to do so — in your own home or somewhere you control.
- You will not place a Terp anywhere people reasonably expect privacy, such as a bathroom or a guest's private room.
- You are responsible for informing others in your home — household members, guests, and bystanders — that a recording device is present, and for obtaining any consent the law where you live requires, including for audio recording.
- You will comply with all applicable laws, including wiretap, eavesdropping, one- and two-party consent, and surveillance laws.
- You will not use a Terp to harass, stalk, spy on, or harm anyone, and you will not point it at neighbors or public spaces in ways that violate their privacy.
The device's visible state light and guest controls are provided to help you meet these responsibilities, but the responsibility is yours.
5. Consent and the people your Terp meets
Features that share anything beyond your household — meeting other Terps, sending a postcard, acting on your behalf through a connector — are off until you turn them on. When you enable them, you are consenting on your own behalf, and you remain responsible for not sharing information about others without their agreement.
6. Acceptable use
You agree not to reverse the Service's safety measures, disrupt or overload our systems, infringe others' rights, or use the Service for anything unlawful. You may, in keeping with the open nature of the creature, extend your own Terp through the SDK, provided you do not use it to harm others or to circumvent the consent and privacy protections described here.
7. Your content and data
What your Terp captures is yours. You grant us only the limited permission needed to operate the features you turn on and to run the Service, as described in the Privacy Policy. You can export or delete your data through the owner portal.
8. Service availability and changes
We work to keep the Service running but do not guarantee it will always be available or error-free. We may update, add, or discontinue features over time. We will give reasonable notice of material changes to these Terms, and continued use after a change means you accept it.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. Terp is a companion device, not a security, safety, or emergency system, and must not be relied on for those purposes.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the Service. Nothing in these Terms limits any liability that cannot be limited under applicable law.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms or use the Service unlawfully.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which Terp is established, without regard to conflict-of-laws principles, and subject to any mandatory consumer protections of your country of residence. [Placeholder — confirm governing law and venue with counsel before launch.]
